Figo® SMS/MMS Terms and Conditions
Introduction
Please read these Figo® SMS/MMS Terms and Conditions carefully before signing up for any Figo Pet Insurance LLC. (“Figo” or “We” or “Us”) text messaging program. By signing up for one or more of Figo’s text messaging programs, you agree to abide by and be bound to these Figo SMS Terms and Conditions. Furthermore, these Figo SMS/MMS Terms and Conditions contain an arbitration clause and class action waiver, which affects how disputes with Figo are resolved.
Program Description
Figo offers a marketing and transactional/customer support MS/MMS program, through which it sends periodically autodialed SMS/MMS messages with marketing content and content pertaining to the administration of your pet insurance policy such as confirming your renewal period.
How We Use Your Information
We use the information collected through SMS/MMS for the following purposes:
To respond to your inquiries and provide customer support
To send you important reminders, updates, and notifications
To improve our services and enhance your experience
Information Sharing
We do not share your personal information with third parties, except in the following circumstances:
With your consent
With our service providers acting on our behalf
To comply with legal obligations
To protect our rights and property
Customer opt-ins will not be shared with affiliates or third parties for marketing purposes.
Message Frequency
The number of text messages that you receive will vary depending on the text messaging programs you sign up to receive messages from.
Cost
There is no fee to receive automated text messages from Us, our agents, affiliates, and independent contractors. However, you may incur a charge for these text messages from your telephone carrier, which is your sole responsibility. Messaging and data rates may be applicable, and you may be responsible for fees or charges from your carrier. You may incur other charges if you leave the Services through links. Check your telephone plan and contact your carrier for details. You represent and warrant that you are authorized to incur such charges and acknowledge that Figo, our agents, affiliates, and independent contractors are not responsible for such charges. Your obligations under this Section will survive the expiration or termination of these Terms.
Supported Carriers
Messaging services are supported by most U.S. wireless carriers; however, availability may vary by carrier and device. Please note, we may be unable to deliver messages to all mobile carriers.
How to Opt-In
Marketing Communications
You acknowledge that by purchasing a Figo Insurance Policy and opting in to receive text messages, you agree to receive policy specific text alerts, transactional 95126, to the phone number provided. Message rates vary. These alerts will be sent to the phone number provided when the policy associated with the phone number is specifically impacted. Text HELP to 95126 for help and/or STOP to 95126 to cancel.
You acknowledge that by voluntarily providing your telephone number(s) to Figo and our respective agents and affiliates and opting in, you expressly agree to receive automated text messages (such as SMS, MMS, or successor protocols or technologies) from Figo, its agents, independent contractors, and affiliates related to promotions, discounts, events and product promotion information, registration, product alterations, changes and updates, service outages, any transaction with Company, and/or your relationship with us. You acknowledge that automated calls or text messages may be made to your telephone number(s) even if your telephone number(s) is registered on any state or federal Do Not Call list. You understand that you may receive automated text messages to any telephone number you provide at any time allowed by law. You also agree that Figo may obtain, and you expressly agree to be contacted at any email addresses or mailing addresses provided by you at any time allowed by law. You understand that you do not have to agree to receive automated promotional texts as a condition of purchasing any goods or services and you may opt-out at any time. You acknowledge that by texting the phone numbers, 844.262.8133 or 844.200.2607, you agree to receive customer support text alerts from our customer support agents. Message rates vary. You may opt-out at any time by sending a “STOP” request to 42681 or 95126, by replying to any text message you receive from us, by contacting us at support@figopetinsurance.com or 1.844.738.3446, or by informing one of our representatives through customer service and specifying that you want to opt out of text messages. You acknowledge and agree to accept a final text message confirming your opt-out. It is your sole responsibility to notify us if you no longer want to receive automated text messages. You waive any rights to bring claims for unauthorized or undesired text messages by failing to opt-out immediately or by failing to follow these instructions. Please allow up to thirty (30) days (or ten (10) business days where required by law) to process any opt-out request.
It is possible that third parties may have come into possession of your contact information independently and unrelated to Figo’s collection of your information and you may continue to receive communications from these third parties despite an opt-out request directed to Figo. We are not responsible for unwanted contact from third parties. In this circumstance, please contact third parties directly to inform them of your communication preferences.

Your Mobile Telephone Number
You verify that any contact information provided to the Company, our respective agents and affiliates, including, but not limited to, your name, mailing address, email address, your residential or business telephone number, and/or your mobile telephone number, is true and accurate. You verify that you are the current subscriber, owner or authorized user of any telephone number that you provide. You are strictly prohibited from providing a phone number that is not your own. If we discover that any information provided in connection with your registration is false or inaccurate, we may suspend or terminate your account access at any time. Should any of your contact information change, including ownership of your telephone numbers, you agree to immediately notify us before the change goes into effect by texting STOP to the applicable short code or any text message you receive from us. If you get a new telephone number, you will need to contact us at support@figopetinsurance.com or 1.844.738.3446.
Access or Delivery to Mobile Network is Not Guaranteed
Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of our control, and We are not responsible or liable for issues.

Eligibility
To receive Our text messages, you must be a resident of the United States and 18 years of age or older. We reserve the right to request prooof that you are at least 18 years of age.
Changes to Terms and Conditions
We may revise, modify, or amend these SMS/MMS Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when updated on our site. You agree to review these SMS/MMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive Our text messages will indicate your acceptance of these changes.
Termination of Text Messaging
We may suspend or terminate your receipt of text message if we believe you are in breach of these Figo SMS/MMS Terms and Conditions.
Indemnification
You agree to indemnify Figo, our agents, affiliates, and independent contractors for any privacy, tort or other claims, including claims under the Federal Telephone Consumer Protection Act or its state law equivalent, relating to your voluntary provision of a telephone number that is not owned by you and/or your failure to notify us of any changes in your contact information, including telephone number. You agree to indemnify, defend and hold us harmless from and against any and all such claims, losses, liability, costs and expenses (including reasonable attorneys’ fees). Figo shall have the exclusive right to choose counsel, at your expense, to defend any such claims.
Data Security
We implement appropriate security measures to protect your information from unauthorized access, disclosure, alteration, or destruction. However, please be aware that no method of transmission over the internet or electronic storage is completely secure.

Standard SMS Messaging Disclosures
